Right of Withdrawal

In brief. As a consumer, you may withdraw from a contract for a paid plan or an add-on package within 14 days without giving any reason. You can nevertheless use Answely straight away – for this, we ask you expressly before every payment; this request does not cost you your right of withdrawal. If you withdraw afterwards, the law would allow us to retain the share attributable to the service already provided; as a goodwill gesture, we currently refund the full amount (section 7). The easiest way to withdraw is the button in your account under "Billing": "Withdraw from contract" for a subscription, "Withdraw from this package" for an add-on package.

1. Who this right of withdrawal applies to

The right of withdrawal is available to consumers. A consumer is any natural person who performs a legal transaction with a trader that is not directly connected with their business or professional activity (Article 22¹ of the Polish Civil Code). At Answely, you selected "Private person" when registering; your account is then a consumer account.

Businesses do not have this right. Clause 1.3 of the Terms of Use applies to them; clause 32 of the same terms sets out which provisions apply differently to consumers.

A special case concerns sole traders: if you conclude the contract in the course of your business but outside your professional specialisation, you are likewise entitled to the right of withdrawal and to protection against unfair contract terms (Article 385⁵ of the Polish Civil Code, Article 38a of the Polish Consumer Rights Act). Whether this applies depends on the scope of your business as entered in the register. If you registered as a business and believe that this applies to you, write to us – we will examine it on a case-by-case basis and, in case of doubt, decide in your favour. In this case, the button in your account is not available to you; withdraw by email or by letter (section 3).

The Free plan is free of charge and does not require an order; it does not need a withdrawal. You can end it at any time by deleting your account.

2. Withdrawal notice

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period will expire after fourteen days from the day of the conclusion of the contract. This applies to each contract separately: to the subscription to a paid plan and to each add-on package.

To exercise the right of withdrawal, you must inform us (LW IT Solutions Company Lukas Wójcik, al. Tadeusza Kościuszki 80/82, lok. 301, 90-437 Łódź, Poland, email: support@answely.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory. You may also withdraw from a subscription using the "Withdraw from contract" button in your account under "Billing"; we will confirm receipt to you by email without delay.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.

As a goodwill gesture, we currently do not claim this amount and refund the full amount paid (section 7).

No early expiry

Your right of withdrawal does not expire before the end of the withdrawal period, even if we have fully performed the service before then. The confirmation we ask you for before payment does not contain an acknowledgement that you lose your right of withdrawal upon full performance (section 8).

3. How to withdraw – step by step

No particular form is required for withdrawal. All that is needed is an unequivocal statement that you are withdrawing from the contract; you do not need to give a reason, and the statement itself costs you nothing. There are three ways:

  • Button in your account (for your subscription and for each add-on package): log in, open "Billing" and, in the "Right of withdrawal" box, select "Withdraw from contract" for your subscription or "Withdraw from this package" next to the add-on package concerned. After a confirmation prompt, the withdrawal has been declared; the page shows the time of receipt (UTC), and you immediately receive a confirmation by email.
  • Email to support@answely.com, preferably from your account's email address, including the word "withdrawal" and the plan or add-on package.
  • Letter to LW IT Solutions Company Lukas Wójcik, al. Tadeusza Kościuszki 80/82, lok. 301, 90-437 Łódź, Poland.

The billing page shows the box during the withdrawal period – for each contract separately, i.e. for the subscription and for each add-on package – and states the date by which you can withdraw. It is displayed until the end of the last day of the period (23:59 Polish time). The button is an additional, convenient route; email and letter always remain open to you throughout the entire period, even if the box is not (or no longer) displayed.

You can also withdraw from an add-on package by email or by letter. Please state the website and the date of purchase.

We confirm receipt of every withdrawal without undue delay on a durable medium, usually by email (Article 30(3) of the Polish Consumer Rights Act). If you do not receive a confirmation within two working days after sending an email, please check your spam folder and write to us again.

4. Model withdrawal form

(Complete and return this form only if you wish to withdraw from the contract.) It corresponds to the statutory model (Annex 2 to the Polish Consumer Rights Act).

  • To: LW IT Solutions Company Lukas Wójcik, al. Tadeusza Kościuszki 80/82, lok. 301, 90-437 Łódź, Poland, email: support@answely.com
  • I/We (*) hereby give notice that I/We (*) withdraw from my/our (*) contract for the provision of the following service: Answely, plan or add-on package for the website: …
  • Ordered on (*): …
  • Name of consumer(s): …
  • Email address of the account: …
  • Address of consumer(s): …
  • Signature of consumer(s) (only if this form is notified on paper): …
  • Date: …

(*) Delete as appropriate.

5. When the contract is concluded and the period begins

The contract for a plan or an add-on package is concluded when you complete the order in your account under "Billing" on the payment page of our payment service provider Stripe and Stripe notifies us of its completion. Immediately afterwards, you receive an email "Your contract and your right of withdrawal". It confirms the contract, states your confirmation of the immediate start and the date by which you can withdraw, and contains the full text of this withdrawal notice – this is your copy on a durable medium.

The period ends at the end of the fourteenth day after the day the contract was concluded; the day on which the contract was concluded is not counted. If the end falls on a Saturday, a Sunday or a public holiday in Poland, the period ends at the end of the next day that is neither a Saturday nor a statutory day off (Articles 111 and 115 of the Polish Civil Code; likewise Article 3(4) of Regulation (EEC, Euratom) No 1182/71). We count the days in Polish time (Europe/Warsaw): the period ends at 23:59 Polish time on its last day, and this is the date stated in the contract confirmation and on the billing page. It is always sufficient to send the statement by the last day. Each contract has its own period: buying an add-on package does not extend the period for your subscription, and vice versa.

Examples: contract concluded on Monday, 5 October 2026 at 10:00 – the period ends on Monday, 19 October 2026 at 23:59. Contract concluded on Saturday, 3 October 2026 – the fourteenth day is Saturday, 17 October, so the period ends on Monday, 19 October 2026 at 23:59. Contract concluded on Wednesday, 28 October 2026 – the fourteenth day is 11 November (Independence Day), so the period ends on Thursday, 12 November 2026 at 23:59.

If we have not informed you about the right of withdrawal, the period is extended by twelve months; if we provide the information within these twelve months, the period ends 14 days after the information has been provided (Article 29 of the Polish Consumer Rights Act).

The renewal of a subscription – for example, the transition from the first to the second month – does not give rise to a new period; it is the same continuing contract. The same applies to an upgrade within an ongoing subscription: although you again confirm the immediate start before paying the difference, this does not give rise to a new contract or a new withdrawal period. If you take out a new subscription after a subscription has ended, that is a new contract with its own period. An add-on package is likewise a new contract each time, with its own period.

6. Effects of withdrawal at Answely

If you withdraw from a subscription, your paid plan ends immediately and your account continues on the free Free plan. Nothing is deleted in the process: websites, index and settings are retained. The limits of the Free plan apply with immediate effect; websites above these limits retain their data, but their answer box is switched off (clause 8.6 of the Terms of Use). Features that are only included from a higher plan upwards are no longer available. If you wish to give up your account entirely, you can delete it after withdrawing.

If you withdraw from an add-on package, we immediately remove the package's answers from the website's additional quota (on the Business plan, from the shared quota of the account) for the current calendar month, including any remainder carried over into that month, as far as they are still credited there. An add-on package that has not yet been paid for (for example by SEPA direct debit) is no longer credited. The answers of a package credited for a past calendar month have already expired; there is nothing left to remove.

We initiate the refund via Stripe to the same means of payment you used to pay – within 14 days of receipt of your withdrawal, currently in full as a goodwill gesture (section 7). How quickly your bank or card provider shows the credit is beyond our control. You incur no fees as a result of the refund. The refund is reviewed and initiated by a human; it is not automatic. Every withdrawal via the button is notified to the operator immediately.

Please do not initiate a chargeback with your bank while we are processing your withdrawal; this delays the refund.

7. If you want to start straight away

Answely is only of use to you while the answer box is working on your website. That is why we activate a paid plan or an add-on package immediately instead of waiting 14 days. This requires your express request (Article 15(3) and Article 21 of the Polish Consumer Rights Act), and that is why we ask for it before every payment.

What you confirm before every payment (tick box on the billing page or when purchasing an add-on package):

I expressly request that Answely starts before the 14-day withdrawal period ends. I know that, in this case, if I withdraw I must pay the share attributable to the service provided up to then.

This tick is only your request for the immediate start; it is not a waiver. It contains no acknowledgement that you lose your right of withdrawal, so your right of withdrawal does not expire early (section 8). As a consumer, you cannot purchase anything without ticking this box, because we activate every paid plan and every add-on package immediately; you use the Free plan without it. We record your confirmation with the time, the wording and the version of this notice displayed – this is at the same time your evidence of what you were told.

This request does not take away your right of withdrawal. It has a different consequence: if you withdraw after performance has begun, you owe us an amount corresponding to the share of the service provided up to the withdrawal (Article 35(1) of the Polish Consumer Rights Act). By law, it would be calculated as follows:

  • Subscription: the proportion of the days from the conclusion of the contract until receipt of your withdrawal to the paid billing period, applied to the amount paid.
  • Add-on package: the proportion of answers that your website delivered after the credit beyond the plan's quota to the answers purchased. If your website did not exceed the plan's quota by the time of withdrawal, we refund the full amount.

As a goodwill gesture, we refund the full amount. We currently do not claim this amount: if you withdraw in time, we refund the full amount paid – for a subscription and for an add-on package, without any deduction. This goodwill gesture is voluntary and does not change the legal position described above. We reserve the right to change or end it at any time for future contracts by amending these conditions (clause 27 of the Terms of Use); contracts already concluded remain unaffected.

An example

Using an assumed amount that is not an Answely price: on the 1st of a 30-day month you book a monthly plan for €30.00 gross and withdraw on the 8th – i.e. after seven of thirty days. By law, we could retain 7/30 of €30.00 = €7.00 and refund €23.00. As a goodwill gesture, we currently refund the full €30.00 to you. For an annual plan, the statutory share would be that of seven days in the year.

We do not offer a purchase with performance beginning only after the withdrawal period has expired; every paid plan and every add-on package starts immediately. This does not put you at a disadvantage: the tick box is only your request for the immediate start, not a waiver – your right of withdrawal remains in full for 14 days, and if you withdraw, we currently refund the full amount. For trying Answely out, there is also the permanently free Free plan, which requires neither a request nor a payment.

8. When the right of withdrawal expires

For services, including digital services, the right of withdrawal can expire early if we have fully performed the service, you had expressly consented to the early start, were informed beforehand that you would lose the right of withdrawal upon full performance, and acknowledged this (Article 38(1)(1) of the Polish Consumer Rights Act). The confirmation we ask you for before payment (section 7) does not contain such a notice. Your right of withdrawal therefore does not expire early but ends when the period under section 5 expires – for a subscription and for an add-on package alike.

This also applies if the service has already been fully performed within the 14 days: for a subscription, this is practically never the case anyway, because the service has been fully performed only when the paid period expires; for an add-on package, it may happen if all of the package's answers have been used up or the calendar month for which it applies has expired. Even then, you may withdraw until the end of the period, and the button in your account is offered for the full 14 days.

We say this expressly because some providers claim the opposite: merely requesting the immediate start does not cause your right of withdrawal to lapse.

9. Withdrawal and cancellation are two different things

WithdrawalCancellation
Whenwithin 14 days of conclusion of the contractat any time
Whoconsumers onlyall customers
Where"Withdraw from contract" or "Withdraw from this package" button, email or letter"Cancel subscription" in your account under "Billing"
Effectimmediate; the plan ends at once, or the package's answers are removedat the end of the paid period
Refundyes, currently in full as a goodwill gesture (section 7)no, the current period remains paid for and usable
Reasonnot requirednot required

Cancellation within the first 14 days is not a withdrawal: if you only select "Cancel subscription", you keep the plan until the end of the paid period and receive nothing back. If you want your money back, withdraw. If you delete your account during an ongoing subscription, we end the subscription immediately and refund the amount paid in advance for the remaining paid period pro rata (clause 9.12 of the Terms of Use); while the withdrawal period is still running, withdrawing before deletion gets you the full amount back.

10. If we cannot agree

First submit a complaint to us – how to do so and the time limits are set out on the Complaints page. If we do not reply to you as a consumer within 14 days, your complaint is deemed to have been accepted (Article 7a of the Polish Consumer Rights Act).

If you do not agree with our reply, you may contact the following bodies independently of us:

  • the Voivodeship Inspector of Trade Inspection (Wojewódzki Inspektor Inspekcji Handlowej) – mediation under Article 36 of the Trade Inspection Act and the permanent consumer arbitration court under Article 37;
  • the municipal or district consumer ombudsman (miejski or powiatowy rzecznik konsumentów) at your place of residence – free advice and assistance;
  • the European Consumer Centre in your country, if you live in another EU Member State;
  • the register of approved bodies and further information from the Office of Competition and Consumer Protection (uokik.gov.pl).

The European Online Dispute Resolution Platform (ODR platform) ceased operating on 20.07.2025 and is no longer available.

We are not bound by any code of conduct. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. Mediation and arbitration require the participation of both parties; you can nevertheless make use of advice and assistance from the consumer ombudsman or the Trade Inspection. Irrespective of this, you may apply to a court at any time; as a consumer, you may bring proceedings at your place of residence (clause 32.10 of the Terms of Use).

Your statutory rights, in particular your rights in the event of non-conformity of digital content or a digital service under Chapter 5b of the Polish Consumer Rights Act, remain unaffected by this notice.

11. What we store in this connection

In connection with your right of withdrawal, we record: the version of this notice displayed, your confirmation of the immediate start (time, wording, IP address, browser), the time each contract was concluded, and any withdrawal via the button in your account (time, subscription or add-on package). We retain this evidence at the latest until 4 years after the deletion of your account (it is deleted once the account has been deleted and the record is older than four years); invoices and refund records for 5 years under Polish tax law. Your withdrawals form part of the data export in your account. Details are set out in the Privacy Policy.
