EU Data Act: switching providers, portability and access to your data

1. Which parts of the Data Act apply to Answely

The Data Act (Regulation (EU) 2023/2854, "Data Act") has applied since 12.09.2025. Answely is a data processing service within the meaning of Art. 2(8): a software service that you use over the internet without operating servers yourself. For you as a customer, the following are therefore of particular relevance:

  • Chapter VI (Art. 23 to 31): switching to another provider or to your own systems, export obligations, switching charges.
  • Art. 32: protection against unlawful access by third-country authorities.
  • Chapter VIII: interoperability and open interfaces.

Other parts do not concern Answely, or only marginally:

  • Chapters II and III (data from connected products): Answely is neither a connected product nor a related service of such a product.
  • Chapter IV (unfair contractual terms, Art. 13): Our Terms of Use do not exclude liability for intent and gross negligence (clause 21.1) and do not prevent you from obtaining and using your own data.
  • Chapter V (data for public sector bodies in cases of exceptional need): We disclose data only upon a lawful, specific request and inform the customer concerned to the extent permitted by law.

Personal data first. The Data Act does not displace the GDPR. You are the controller for your visitors' data, and we process it on your behalf under the Data Processing Agreement. Your own rights as an individual (access, portability under Art. 20 GDPR) are described under Access and deletion. Everything on this page applies within these limits.

2. Switching away from Answely (Art. 23 to 27)

You can switch at any time, to another provider or to a solution of your own. Answely is built so that leaving does not damage your website: if you remove the script answely.js, the answer box disappears and your normal search works as before. There is no content that is held only by us and would be lost without us – the index consists of your own public pages.

In accordance with Art. 25, we commit to the following:

  • Notice period. A paid plan ends at the end of the current billing period, i.e. after no more than one month in the case of monthly payment. In the case of annual payment, you can choose "Cancel to switch provider" in your account under "Billing": the subscription then ends no later than two months after your declaration (Art. 25(2)(a)), or at the end of the period already paid for if that is earlier. Until then, everything remains usable, including the export; you receive a confirmation by email. If the subscription thereby ends before the end of the period already paid for, we refund the amount paid in advance for the period thereafter on a pro rata basis (clause 9.9 of the Terms of Use); we initiate the refund manually via Stripe. The same applies if you delete your account during a paid subscription (clause 9.12 of the Terms of Use). We reserve the right to adjust this rule for future billing periods by amending the Terms of Use, unless mandatory law precludes this.
  • No deletion as a result of termination. When the paid plan ends, your account reverts to the Free plan. Your websites, settings and invoices are retained, and export remains possible until you delete the account yourself. This creates no time pressure for retrieving data.
  • Transitional period. If you expressly request a switch with assistance, the service remains usable on request to the previous extent for up to 30 days after termination takes effect, so that your new solution can start up in parallel. If this is not technically feasible within that time, we will inform you within 14 working days of your switching request, state the reason and extend the period by the time required, up to a maximum of seven months. During the transitional period, the previous plan continues without any further charge.
  • Retrieval period. After the transitional period, your data remains retrievable for at least 30 days; since the account continues to exist in the Free plan anyway, this is fulfilled without any action on your part.
  • Assistance. We answer questions about switching via the support form. The export is available in the account without a separate request (section 3).
  • Deletion after switching. If you delete the account, we immediately delete the account and any workspaces without other members together with their websites, and remove their index within 24 hours; workspaces with other members pass, together with their websites, to a member – preferably to the longest-standing admin, otherwise to the longest-standing member. Excepted are invoices (5 years, Polish tax law) and the record of your consent to the legal texts; logs and support requests expire after the periods set out in Access and deletion. Deleted data remains in our encrypted off-site copies until they expire (daily copies 7 days, weekly copies 364 days), before transfer for no more than 8 days unencrypted on a storage device at our server, and is not used for anything else; details are set out in the Privacy Policy.
  • No switching charges. We charge nothing for termination, export or switching, including for the transitional period, neither now nor after 12.01.2027, from which date Art. 29 prohibits switching charges entirely. There are no charges for data egress.
  • No obstacles. No minimum term beyond the paid period, no proprietary format for your data, no penalty for leaving (Art. 23 and 27).

3. Exportable data and formats (Art. 25 and 26)

You will find the export in the account under "Settings → Your data". After entering your password, you download everything as a single JSON file or as a ZIP containing one CSV table per area together with the complete JSON file. For security reasons, this is possible at most three times per hour. In the CSV tables, cells that a spreadsheet program would execute as a formula are neutralised with a leading apostrophe; nested information is stored as JSON in the cell.

What is not exported, and why:

  • The index. It consists of sections of your own public pages and vectors of the embedding model calculated from them. You hold the pages yourself; the vectors are tied to our model and worthless to another provider.
  • Documents from the push interface and the WordPress synchronisation. They are stored in the index and are therefore likewise not included in the export. They are content that your own system sent to us and that remains available there. There is no separate export of push documents.
  • Individual questions and answers. In the default setting, we do not store them. Even with question analysis switched on, only groups are included in the export, never individual questions.
  • Answer test reports, approval reports and success measurement. Short-lived technical reports without content; the definitions (test questions, rules) are part of the configuration and are exported. The totals of the success measurement are shown in the account; the export does not contain them.
  • Payment methods. They are held by Stripe and can be viewed in Stripe's customer portal.
  • Internal information. The internal reason for a suspension imposed by us and data of other members of a workspace (their names and addresses are their data).

Functional equivalence (Art. 30(1)) is an obligation for infrastructure services and does not apply to a software service such as Answely. We fulfil the obligation applicable to us – to provide open interfaces and to enable the export of all exportable data in a structured, commonly used and machine-readable format – through the export in the account and the interfaces in section 5.

4. Jurisdiction of our infrastructure and governmental access (Art. 28 and 32)

  • Location. Answely runs on own hardware in Łódź, Poland: website, account, databases and answer service on our own server, language models and embedding – our own AI, self-hosted – on our own servers in the same internal network. There is no cloud or hosting provider between you and us.
  • Off-site copies. A nightly copy of the databases is encrypted on our server before it is transferred to Google Cloud Storage in the Warsaw region (europe-central2). Only the operator holds the key. Before transfer, the copy (dumps of all databases on the server and a file copy of /var/www including configuration files) remains unencrypted for no more than 8 days on a storage device at our server in Łódź. Google acts as a sub-processor for this; see Sub-processors. Any access by authorities outside the EU to Google's parent company would encounter only encrypted blocks that cannot be read without the key.
  • Payments. Stripe Payments Europe, Ltd. (Ireland) processes payments and transfers billing data to Stripe, Inc. in the USA. Your visitors' data never reaches Stripe.
  • Email. Our emails to you, including the optional knowledge-gap report with groups of masked questions, and your emails to addresses under @answely.com are routed via Namecheap Private Email (Namecheap, Inc., USA), on the basis of the EU standard contractual clauses. Namecheap is also the registrar and DNS provider of answely.com.
  • Applicable law. Our own infrastructure is subject to Polish law and the law of the European Union.
  • Requests from third-country authorities. We comply with a decision of a court or authority of a third country only if it is based on an international agreement (Art. 32(2)) or the conditions of Art. 32(3) are met. We examine every request, disclose only what is strictly necessary and inform the customer concerned in advance, where permissible.
  • Safeguards. Encryption in transit, encrypted off-site copies, access control with mandatory two-factor authentication for administrators and logs without content are described in the technical and organisational measures. To be candid: the databases on our own server are not encrypted at rest, nor is the daily copy before transfer.

5. Interoperability (Chapter VIII)

Answely uses open, documented interfaces. The developer documentation is publicly available at answely.com/docs.

  • Search and answer interface. JSON over HTTPS; answers are streamed as server-sent events. You can also use it to integrate answers into your own interfaces.
  • Push interface (from the Pro plan). Import and delete documents as JSON over HTTPS, protected by a token known only to you.
  • WordPress plugin. Synchronises published, public content via the push interface; nothing about it is tied to Answely that you could not rebuild yourself.
  • MCP search access. On request, Answely provides a pure text search via the open Model Context Protocol so that AI assistants of your choice can search your public content.
  • Interchangeable language model. Internally, Answely addresses the language model via a standardised interface. This mainly concerns us: we are not tied to any model provider. For you, it means that your configuration does not depend on a particular model.
  • Export. JSON and CSV with self-explanatory field names; no particular tool is required to read them.

We will adopt the harmonised standards and common specifications for data processing services as soon as they are published.
